Holding Orthodontists Responsible for Negligence

There are, unfortunately, a variety of ways that dentists, orthodontists, and other medical professionals can cause injuries to patients when they’re not careful or attentive. Your teeth, gums, roots, tongue, and jaw are all delicate and damaging any of them can result in extreme pain, nerve damage, infection, decay, and more. Though we should trust our dental professionals to handle their procedures with care, this doesn’t always happen, and some people find themselves in more pain than they were when they arrived at their appointment.

One of the most common dental malpractice cases associated with orthodontics is root resorption. Many reports have shown that orthodontically treated patients are more likely to suffer from root resorption, which can result in losing your tooth or teeth entirely. If you have been affected by root resorption as a result of orthodontic negligence, we want to hear from you. Our New York root resorption attorneys at Chianese & Reilly Law have the experience needed to investigate your situation and hold professionals responsible for failing to meet the standard of care they owe to you, the patient.

Call us today for a free, no-obligation consultation at (516) 614-6516. Our team is known throughout our community for our extensive experience in dental malpractice and can apply our past successes to your case.

What is Root Resorption?

Root resorption, or the shortening of the roots, often occurs in all patients who have had orthodontic work done. Because orthodontics involves moving the teeth to realign your teeth or jaw, the roots can shorten as a result. The roots can begin disintegrating, and if left untreated, lead to teeth becoming mobile and then falling out entirely.

While in many cases this is natural and not a result of negligence, there are some instances in which it can be proven that improper dental treatment led to root resorption.

Some symptoms of root resorption include:

  • Dull, aching sensations
  • Loose or wiggly tooth or teeth
  • Discoloration of tooth or teeth

How Orthodontists Can Be Held Liable

While one of the main ways orthodontists can be held responsible for root absorption is if it can be proven that their treatments directly caused the resorption and subsequent tooth loss, patients can also hold them responsible for failing to diagnose and property treat it when they see it.

Orthodontists have an obligation to inform patients about any health concerns when they notice them and either treat them themselves or refer them to a specialist. For example, if an orthodontist notices a change in root structure or suspects root resorption is taking place, the proper protocol is to take x-rays to monitor the activity, and then stop the forced movement of the teeth. If a professional fails to diagnose this condition and properly treat it, they can be held liable for negligence.
