Helping Clients After Misdiagnosis

Misdiagnosis of an oral cyst or cancer can cause very serious injury to a patient, particularly since the failure to recognize and treat cancer or cysts early on can drastically and adversely affect a patient’s chances at remission and survival. Treatments given at an earlier stage of cancer or tumors are also less debilitating to the patient and cost less, which means a misdiagnosis can be a more painful and stressful experience both personally and financially as well.

There are many cysts, tumors, lesions, and cancers that may be found in the mouth. Many of them are harmless but a number of them can cause serious problems if left untreated or are treated improperly. If you have been misdiagnosed or your conditions have been made worse as a result of your dental professional’s negligence, don’t hesitate to reach out to our New York oral tumor attorneys for a free consultation. Chianese & Reilly Law invests time and energy into each of our cases to fight for our clients’ rights to compensation after a traumatic experience.

Common Forms of Misdiagnosis

If a dentist or pathologist misdiagnoses a cyst it often leads to the improper treatment, which may result in a recurrence of the cyst. The treatment of a recurrence is often much more substantial than had the proper diagnosis initially been made. A common error is diagnosing a cyst as a benign cyst when it is a much more aggressive cyst. In many cases of a misdiagnosed cyst or cancer, the treatment will include removal of large areas of bone or even sections of the jaw which then need to be re-built with bone from other parts of the body, such as the leg or hip.

There are several ways dentists or pathologists can misdiagnosis cases of cysts or cancer; what follows are some of the most commonly claimed:

  • Not taking patient’s complaints of pain or other symptoms seriously
  • Not ordering the appropriate tests, x-rays, scans, MRIs, biopsies, etc.
  • Interpreting test results incorrectly and/or failing to follow up on tests
  • Failing to identify an obvious tumor or lump
  • Diagnosing a tumor as benign when it was malignant
  • Failing to recognize and identify common symptoms of a particular type of cancer
